This Privacy Policy describes how Ecafintch S.A.S. ("Ecafintch", "we") collects, uses, stores and protects the personal data of users and subscribers of ecafintch.com, in compliance with the Organic Law on the Protection of Personal Data of Ecuador (LOPDP, Official Gazette Fifth Supplement No. 459, 26-May-2021) and its Regulation.
1. Data controller
Ecafintch S.A.S., Tax ID 1793204856001, registered office at Av. República de El Salvador N34-183 y Suiza, Murano Plaza Building, 9th floor, office 902, Quito, Ecuador. Data protection officer: privacidad@ecafintch.com.
2. Data we collect
We collect: (i) full name, email address and, where applicable, ID number, when you subscribe to the opportunity list or create an account; (ii) technical data such as IP address, browser type and pages visited; (iii) if you become an investor, additional financial data required by anti-money-laundering regulation.
3. Purposes
Data is used to: send you information about investment projects, execute loan contracts, comply with tax and anti-money-laundering obligations before the UAFE, improve the website and answer enquiries. We do not perform automated profiling with significant legal effects.
4. Legal basis
We process data based on your express consent, the performance of a contract to which you are a party (or pre-contractual measures at your request), compliance with applicable legal obligations and our legitimate interest in operating the site.
5. Retention
Subscriber data is kept until you request deletion. Investor data is kept for the full contractual relationship and, once finished, for an additional ten (10) years, as required by anti-money-laundering rules.
6. Recipients
We share data with: technology providers acting as data processors (email, hosting); public notaries and registries for investment operations; competent authorities upon legal request (SCVS, SRI, UAFE, judiciary).
7. Your rights
As the data subject you may exercise the rights of access, rectification, update, deletion, objection, cancellation, portability, the right not to be subject to automated decisions and the right to consult the national registry. To do so, write to privacidad@ecafintch.com attaching a copy of your ID document. You may also file a claim before the Ecuadorian Superintendency for the Protection of Personal Data.
8. Security
We apply reasonable technical and organisational measures: encryption in transit (TLS 1.3), role-based access control, encrypted backups and audit logging. No system is absolutely secure; please do not share your password with third parties.
9. Changes to this policy
We may update this policy. The current version is always published at ecafintch.com with its update date.
